A: In NJ the agent would be paid full commission when you close on the sale with the renter/buyer.

A: In my area, some Realtors can have the buyer sign an Exclusive Agency agreement that says they will represent the buyer for the entire year, up until the purchase date. They will then represent the buyer on the sale, and due the commission at that time.

I dont know what agents do in your area.

A: It depends on the listing contract and the parameters set forth in the contract as to how the agent is paid to facilitate the rent to own sale or contract sale.

Massachusetts Attorney General Martha Coakley slammed a private network used by lenders for loan trading as she launched a far-reaching probe into whether banks violated state property-recording laws during the housing boom — and broke foreclosure rules during the bust that followed.

“From predatory loans to ‘robo-signing’ to servicing fraud, the banks continue to go merrily on their way while consumers, the real estate industry and the commonwealth of Massachusetts are being cheated,” Coakley told the Herald yesterday.

“The inability to get a handle on the instability in the real estate market continues to affect Massachusetts and the entire national economy,” she said.

Coakley’s probe comes as several county registers of deeds have questioned the validity of paperwork banks have filed on thousands of home sales, refinancings and foreclosures.

The registers claim many lenders used “robo-signers” — employees who OK’d hundreds of documents per day without reading them, often signing papers using fake names or titles.

Banks also often used Mortgage Electronic Registration Systems Inc., or MERS — a private network that lenders created to trade home loans among themselves — instead of documenting mortgage transfers with registers.

Some registers believe such actions violate Massachusetts property-records laws, voiding the documents in question and “clouding” thousands of land titles.

Consumers with clouded titles could find their homes hard to sell or refinance without going to court to clear up problems.

Some registers also claim banks illegally avoided millions of dollars in fees by transferring mortgages via MERS instead of local registries.

MERS spokeswoman Janis Smith dismissed the allegations against her firm as “without merit.”

Coakley, who’s currently working with other states on an “global” settlement over paperwork flaws, promised to exclude the MERS issue from any deal until she fully investigates the problem’s scope.

“Massachusetts will not sign on to any global agreement with the banks if it includes a comprehensive liability release regarding securitization and the MERS conduct,” she vowed in a letter yesterday to all 21 county registers of deeds.

Southern Essex County Register John O’Brien, who spearheaded the drive against paperwork flaws, lauded such talk.

“I think this sends a message loud and clear to banks that Massachusetts will hold them accountable,” O’Brien said.

After a very rainy spring, conditions in the garden have become very dry. The recent hot weather has increased stress on gardeners as well as plants, so when you work in the garden, wear sunscreen and drink lots of water.

Plants installed over the last two years will need supplemental water to keep them going during hot and dry weather spells like this one. It is so dry now that plants installed three years ago should be watered too.

Established plants in my home garden are holding up well, but the sunny parts of my lawn are turning tan. Since I do not water my lawn, it is going dormant. That saves me time, as I have stopped mowing. Full story…

As a luxury real estate marketing professional, if you want to challenge the market leader in your area the last thing you want to do is imitate the incumbent.  This is one of those branding traps that even some of the biggest brands fall into and get nowhere as a result.  Originality and distinctiveness is the route to market leadership.  As a challenger, your best best is to take the opposite position as the market leader or else “own” (excel at) the attribute that represents your competitor’s greatest weakness.

In a previous post we pointed out how Pepsi has slipped to the #3 soft drink and is desparately trying to get back in the race.  They went after the strong association that Coke established over years with Santa in their ads. Now they Full story…

Developers in Austin have applied for a zoning change at the 800 block of Congress Avenue in Austin to pursue a boutique hotel with 120,000 square feet of office space according to an article from The Statesmen. The project would occupy the land currently taken by the Bosch-Hogg Building which was originally built in 1897 as a three story building with three additional floors added to the structure in 1984. Austin developer David Kahn, managing partner of Colina West Limited, plans to build a 28 story mixed use property in its place but will need the zoning change to allow for a larger building than is currently permitted for that site.

“I saw an opportunity to bring some excitement and energy to that part of downtown,” said Kahn.

In an effort to promote the benefits of solar energy, the Canadian Solar Industry Association is trying to raise $2 million from its members to build a media campaign in Ontario. The association believes there’s a vast misunderstanding about solar power and that it is wrongly gaining momentum as a political hot potato in the lead up to the Oct. 6
